These Terms of Service are the binding agreement between you and Press for the free preview, the keep purchase, add-ons, and the Care Plan.
These Terms of Service (the Terms) govern your access to and use of the Press website at gopress.studio and the preview-building, website, add-on, and subscription services offered through it (together, the Service). Press is operated by PRESS STUDIO (SSM Registration No. RA0136980-M), a business registered in Malaysia with the Companies Commission of Malaysia (SSM) (Press, we, us, or our). They sit alongside our plain-English six promises, which describe the spirit of how we work; these Terms are the detailed, binding version of that deal.
Please read these Terms carefully before using the Service. By accessing the site, requesting a preview, creating an account, or making a payment, you agree to be bound by these Terms. If you do not agree, do not use the Service.
This document is provided for transparency and is intended to be readable. It is a binding agreement. Where a separate signed agreement, statement of work, or order form exists between you and Press and conflicts with these Terms, that separate agreement governs for the matters it covers; these Terms govern everything else. Where the editorial six promises page describes a payment or refund arrangement that differs from these Terms or the Refund & Subscription Terms, these Terms and the Refund & Subscription Terms govern the actual contract. This is a draft pending review by counsel qualified in Malaysia (and, where relevant, in your own jurisdiction) before publication.
01 Acceptance of these Terms
These Terms form a contract between you (the Client, you, or your) and PRESS STUDIO (SSM Registration No. RA0136980-M), the business registered in Malaysia that operates Press.
You accept these Terms, and they become legally binding on you, when you do any of the following, whichever happens first:
- access, browse, or use the Press website or Service;
- submit a request or brief for a free preview;
- create or sign in to a Press account; or
- make any payment to Press (for the keep purchase, an add-on, or the Care Plan).
Where the checkout, sign-up, or request flow asks you to tick a box or click a button confirming that you agree to these Terms, that click is your electronic acceptance. Under the Electronic Commerce Act 2006 (Act 658) of Malaysia, a contract is not denied legal effect merely because it was formed electronically, and your affirmative click is a valid expression of acceptance. Your agreement is also governed by the general law of contract in the Contracts Act 1950 (Act 136) (offer, acceptance, and free consent).
If you are entering into these Terms on behalf of a company or other organisation, you confirm that you have the authority to bind that organisation, and you and your refer to that organisation.
02 Definitions
In these Terms, capitalised words have the meanings given below.

03 Eligibility and accounts
Age and capacity
You must be at least eighteen (18) years old to use the Service. Eighteen is the age of majority in Malaysia under the Age of Majority Act 1971, and under section 11 of the Contracts Act 1950 a contract entered into by a minor is generally void. By using the Service you confirm that you are 18 or older and have the legal capacity to enter into a binding contract. The Service is not directed to children, and we do not knowingly collect personal data from anyone under 18.
Account registration
Some parts of the Service require an account. You may create an account with your name, email, and a password, or sign in using Google. You agree to provide accurate, current, and complete information and to keep it up to date. Each account is for one person; you may not share your login with others or let anyone else use your account.
Account security
You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. We store passwords only as a secure cryptographic hash and never in plain text. If you sign in with Google, your access is also subject to Google's terms. Notify us promptly at support@gopress.studio if you suspect unauthorised use of your account. We may suspend or close an account that we reasonably believe has been compromised or used in breach of these Terms.
04 The Service
Press is a preview-first website service. We hand-build a website Preview for you, free of charge. You pay only if you decide to keep it. This section describes what is included and how each part works.
The free Preview
On receiving your brief, we prepare a Preview consisting of up to four (4) pages (typically a homepage, an about page, a work or services page, and a contact page) plus one (1) opt-in form or one (1) basic API integration. No card is required to request a Preview, and requesting one places you under no obligation to buy anything.
We aim to deliver your Preview within five (5) working days of receiving your brief, and we treat that window as a genuine discipline. However, the five-working-day window is a target and good-faith estimate, not a guaranteed delivery date or a warranty. Delivery time can be affected by the completeness of your brief, your responses to questions, and matters outside our reasonable control (see Force majeure). If we expect the window to slip, we will tell you. Nothing in this paragraph limits any non-excludable statutory right you may have under the Consumer Protection Act 1999 (Act 599) of Malaysia.
Once we notify you that your Preview is ready, it remains available for review for seven (7) days. If you do not purchase within that window, the file is closed and the preview files are deleted (see the Privacy Policy for our retention practice). You may ask us to re-open a closed file, but we may need to rebuild the Preview and cannot promise the closed version can be restored.
Keeping the website (the Hand-set website)
If you decide to keep your Preview, the keep fee is a single up-front payment, USD $299, MYR RM899, or SGD S$399, in your quoted billing currency (see Prices and currency), charged in full to your card through our payment processor, Stripe, at checkout. It is one charge: there is no deposit, instalment, or split between selection and delivery. On full payment of the keep fee, ownership of the delivered website source code and Deliverables transfers to you, as described in Intellectual property. For how this fee is treated on refund (it is non-refundable once paid, subject to your statutory rights), see Cancellation and refunds below and the Refund & Subscription Terms.
Revisions
Every kept Hand-set website includes a Revision Window of ten (10) days, beginning on the date you pay the keep fee (your date of purchase). During the Revision Window you may request as many revision rounds as you need at no additional charge. A revision round is a single, consolidated set of change requests. Once the Revision Window closes (ten days after the date of purchase), each further revision round requires purchasing the Extra revision add-on ($49 / RM99 / S$49 each, in your billing currency).
Add-ons
You may purchase the following optional one-time add-ons. Add-ons are billed through our billing system against the card saved with your account, in your account's billing currency (see Prices and currency):

The Care Plan
The Care Plan is an optional, recurring, auto-renewing subscription. It is offered at $19 / RM49 / S$29 per month or $190 / RM490 / S$290 per year, in your billing currency (USD / MYR / SGD; the annual rate is the equivalent of two months free). The Care Plan includes web hosting; handling of SSL and domain renewal; up to two small content edits per month; and a monthly uptime and security check.
The Care Plan renews automatically until you cancel. You may cancel online at any time through your account; cancellation takes effect at the end of the current paid term, and the plan stays active and reversible until then. Monthly and annual cadences can be switched, with any switch taking effect at the next renewal (no proration). The full disclosure, auto-renewal consent, cancellation, plan-switching, renewal-reminder, and refund mechanics, including the rights of consumers in U.S. states with auto-renewal laws (such as California's Automatic Renewal Law), are set out in the Refund & Subscription Terms.
Because the Care Plan renews automatically and charges your card on a recurring basis, the full billing, auto-renewal, cancellation, plan-switching, and refund terms, including your right to cancel, are set out in the Refund & Subscription Terms, which form part of these Terms. Please read them before subscribing.
05 Fees, taxes, currency, and payment
Prices and currency
Prices are displayed and charged in one of three supported currencies: US Dollars (USD), Malaysian Ringgit (MYR), or Singapore Dollars (SGD), based on your location when you request a preview. Each price is a hand-set price point in its currency, not a converted amount. The currency quoted to you is the currency charged at checkout, and the currency of your first purchase becomes your account's billing currency for all later charges (add-ons and the Care Plan). The keep fee, add-on prices, and Care Plan prices are as set out in The Service and on the relevant checkout page at the time of purchase. We may change prices for future purchases or future subscription terms; price changes are handled as described in the Refund & Subscription Terms and in Changes below.
Payment processing
Card payments are processed by Stripe. When you pay, your card details are entered directly into Stripe's secure payment fields. Press does not see, receive, or store your full card number; we store only a Stripe customer reference and the card brand and last four digits that Stripe provides. For the keep purchase, your card may be saved with Stripe so that later add-on and Care Plan charges can be made against it. Your use of Stripe is also subject to Stripe's own terms.
Taxes
Prices are exclusive of taxes unless stated otherwise. You are responsible for any taxes, duties, or levies that apply to your purchase, except for taxes on our income. Depending on the supply, Malaysian Sales and Service Tax (SST), including service tax on digital services, and/or taxes in your own country may apply and may be added to the amount you are charged. Where we are required to collect a tax, we will show or add it before you confirm payment.
Failed or reversed payments
If a payment fails, is reversed, or is charged back without a valid basis, we may suspend the affected service (including the Care Plan) until the amount is settled. Recurring Care Plan charges that fail may be retried on our payment processor's standard schedule, as described in the Refund & Subscription Terms.
06 Cancellation and refunds
This section explains your cancellation rights and how refunds work, and where those rights come from. It is in addition to the cancellation and refund mechanics in the Refund & Subscription Terms, which you should read for the detail.
No general cooling-off period under Malaysian law
Malaysian law does not provide a general statutory cooling-off or right-of-withdrawal period for ordinary online purchases. We say this plainly so you are not misled into expecting an automatic refund window that Malaysian law does not grant. Specific consumer rights may still apply (see Disclaimers and Governing law and disputes), and our own refund treatment for each product is set out below and in the Refund & Subscription Terms.
Refund of the keep fee
The free Preview always stays free and places you under no obligation to buy. If you do choose to keep your Preview and pay the single up-front keep fee (USD $299 / MYR RM899 / SGD S$399, in your quoted billing currency), that fee is non-refundable once paid, because it funds bespoke work we carry out specifically for you and you commit to it only after seeing the finished Preview. Malaysian law does not provide a general cooling-off or change-of-mind refund period for ordinary online purchases, and we do not offer one for the keep fee. This does not affect your non-excludable statutory rights: if the delivered website is defective, not as described, or not performed with reasonable care and skill, your remedies under the Consumer Protection Act 1999, including a refund for a substantial failure, still apply. See the Refund & Subscription Terms and Disclaimers.
Add-ons are non-refundable once purchased, subject to your non-excludable statutory rights (for defective or misdescribed work). Care Plan subscription cancellations and refunds are governed by the Refund & Subscription Terms.
Auto-renewing subscriptions: easy cancellation
For the auto-renewing Care Plan, you can cancel online through your account, by the same kind of method you used to subscribe, and we provide renewal information as described in the Refund & Subscription Terms. These measures are intended to give effect to auto-renewal and "click-to-cancel" rights under laws such as California's Automatic Renewal Law, in addition to your Malaysian consumer rights.
07 Intellectual property and ownership
Before full payment
Until you have paid the keep fee in full, the Preview and all related Deliverables, designs, code, and materials prepared by Press remain the property of Press. Before full payment, we grant you a limited, non-exclusive, non-transferable, revocable licence to view and evaluate the Preview for the sole purpose of deciding whether to keep it. You may not copy, host, republish, sell, deploy, or commercially use the Preview, or remove any watermark or notice, before full payment.
On full payment
On full payment of the keep fee, we transfer to you ownership of the source code and Deliverables of your Hand-set website, except for: (a) any third-party or open-source components, which remain licensed under their own terms; (b) Press's own pre-existing tools, frameworks, and know-how, which we license to you only as needed to use your website; and (c) the materials you supplied, which remain yours. The transfer takes effect on full payment: not before, and not held in escrow.
Your materials
Content you provide to us, including your logo, copy, images, and brand assets, remains yours. You grant Press a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, and incorporate that Content as needed to provide the Service (for example, to build and deliver your Preview and Hand-set website). You confirm and warrant that you own or have the necessary rights and permissions to all Content you supply, and that our use of it as permitted here will not infringe anyone's rights or any law.
Portfolio and showcase licence
You grant Press an ongoing, non-exclusive, royalty-free licence to display the work we created for you, including the Preview and Hand-set website, in our own portfolio, gallery, case studies, and marketing, as a sample of our work. If you ask us to, we will remove your name from any such display. You can make this request at any time by emailing support@gopress.studio.
08 Client responsibilities and Content warranties
You are responsible for the Content you provide and for your use of the Service. You represent, warrant, and agree that:
- all Content and information you provide is accurate, current, and complete;
- you own, or have all necessary rights, licences, and permissions to use and to authorise us to use, the Content you supply;
- your Content and your use of the Service comply with all applicable laws and do not infringe the intellectual property, privacy, or other rights of any third party;
- you will respond to our reasonable requests and provide the materials we need to deliver the Service within a reasonable time; and
- you will use the Service only for lawful purposes and in accordance with the Acceptable Use Policy, which forms part of these Terms.
We may refuse, suspend, or stop work on any request, Preview, or website that we reasonably believe breaches these Terms, the Acceptable Use Policy, or any law.
09 Third-party services
The Service relies on third-party providers, including Stripe (payments), email and hosting providers, domain registrars, and, if you choose it, Google (sign-in). Your use of those services may be subject to the third party's own terms and policies, and you are responsible for complying with them where they apply to you.
We are not responsible or liable for the acts, omissions, availability, outages, security incidents, or policy decisions of third-party providers that are outside our reasonable control. If a third-party service is unavailable or changes, we will use reasonable efforts to maintain the Service, but we do not guarantee uninterrupted operation of components we do not control.
10 Disclaimers and warranties
Except as expressly stated in these Terms, and to the maximum extent permitted by law, the Service and all Deliverables are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
In particular, we do not warrant or guarantee that:
- the Service will be uninterrupted, timely, secure, or error-free;
- your Preview will be delivered within any specific period (the five-working-day window is a target, not a guarantee);
- your website will achieve any particular search-engine ranking, traffic, conversion, revenue, or other business result; or
- any defects will be corrected, beyond the revision and Care Plan terms set out in these Terms.
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy that you have under the Consumer Protection Act 1999 (Act 599) of Malaysia (or other consumer-protection law that applies to you) and that cannot lawfully be excluded, for example, statutory implied guarantees of acceptable quality and reasonable care and skill for consumer transactions. Those non-excludable rights are not waived by the disclaimers above, and where this section conflicts with such a right, the statutory right prevails.
11 Limitation of liability
To the maximum extent permitted by law, and subject to the Disclaimers note above on non-excludable rights:
- Press will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business opportunity, arising out of or relating to the Service, whether based on contract, tort (including negligence), statute, or otherwise, even if we have been advised of the possibility of such damages; and
- Press's total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of (a) the total amount you actually paid to Press for the specific service giving rise to the claim, or (b) the total amount you paid to Press in the twelve (12) months immediately before the event giving rise to the claim.
These limits apply to the fullest extent permitted by law. Nothing in this section limits or excludes liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any non-excludable liability under the Consumer Protection Act 1999 or other applicable consumer-protection law.
12 Indemnification
To the extent permitted by law, you agree to indemnify, defend, and hold harmless Press, its officers, employees, and contractors from and against any claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) the Content you provide and our permitted use of it; (b) your breach of these Terms, the Acceptable Use Policy, or any law; or (c) your misuse of the Service. We will notify you of any such claim and may, at our option, participate in its defence; you may not settle any claim in a way that imposes obligations on Press without our prior written consent. This indemnity does not apply to the extent a claim arises from Press's own breach, negligence, or wrongful act, and nothing in it requires you to give up any non-excludable consumer right.
13 Term, suspension, and termination
These Terms apply for as long as you use the Service or hold an account, and continue to apply to past transactions afterward.
You may stop using the Service at any time and may ask us to close your account by emailing support@gopress.studio. If you have an active Care Plan, cancellation of the subscription is governed by the Refund & Subscription Terms.
We may suspend or terminate your access to all or part of the Service, with notice where practicable, if you breach these Terms or the Acceptable Use Policy, if required by law, or to protect the Service, other users, or third parties. We may also discontinue a feature or the Service generally on reasonable notice.
On termination: (a) your right to use the Service ends; (b) Deliverables for which you have paid in full remain yours; (c) Deliverables and Previews not paid for in full remain Press's property and the evaluation licence ends; and (d) you may request deletion of your brief, draft, and logo as described in our Privacy Policy. Sections that by their nature should survive termination, including Intellectual property, Fees, taxes, currency, and payment (for amounts owed), Disclaimers, Limitation of liability, Indemnification, and Governing law and disputes, survive.
14 Changes to the Service and to these Terms
We may modify, add to, or discontinue parts of the Service. We may also update these Terms from time to time, for example, to reflect changes in the Service, our providers, or applicable law. When we make a material change, we will post the updated Terms on this page and, where appropriate, give notice through the site or by email; changes take effect when posted, unless we state a later date.
Changes apply going forward. If you continue to use the Service after a change takes effect, you accept the updated Terms. If you do not agree to a change, you should stop using the Service; for the Care Plan, any change that affects recurring billing is handled as described in the Refund & Subscription Terms.
15 Governing law and dispute resolution
These Terms and any dispute or claim arising out of or in connection with them or the Service are governed by the laws of Malaysia, without regard to conflict-of-laws rules.
If a dispute arises, the parties will first try in good faith to resolve it informally. You can raise any concern by emailing support@gopress.studio, and we will work with you to find a fair resolution.
If a dispute cannot be resolved informally, it will be subject to the courts of Malaysia, and you and Press submit to the jurisdiction of those courts for that purpose.
This choice of Malaysian law and courts does not deprive you of the protection of mandatory consumer-protection rights available to you under the law of the country where you live (for example, the right of a Malaysian consumer to bring an eligible claim to the Tribunal for Consumer Claims Malaysia, or rights under your local law). It does not, and cannot, oust the non-excludable protections of the Consumer Protection Act 1999 for Malaysian consumers.
16 General terms
Force majeure
Press is not liable for any delay or failure to perform caused by events beyond its reasonable control, including acts of God, natural disasters, epidemics, war, civil unrest, government action, strikes, internet or power outages, and failures of third-party providers or infrastructure. The five-working-day Preview target does not run during such events.
Notices
We may give you notices by email to the address on your account or by posting on the site. You may send legal notices to Press by email at support@gopress.studio.
Severability
If any provision of these Terms is held invalid or unenforceable, that provision is to be limited or removed to the minimum extent necessary, and the remaining provisions stay in full force and effect.
Entire agreement
These Terms, together with the documents they incorporate by reference (the Privacy Policy, Cookie Policy, Acceptable Use Policy, and Refund & Subscription Terms), and any separate signed agreement or order form, are the entire agreement between you and Press regarding the Service, and supersede any prior understanding on that subject.
No waiver
Our failure to enforce any provision is not a waiver of our right to do so later. A waiver is effective only if given in writing.
Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganisation, or sale of assets, on notice to you.
Language and translation
These Terms are written in English. If we provide a translation (for example, in Bahasa Melayu) for convenience and there is any conflict, the English version prevails, except where applicable law requires the local-language version to govern.
17 Business identity and contact
The following details are provided so you know who you are contracting with, consistent with the disclosure expectations of the Malaysian Consumer Protection (Electronic Trade Transactions) Regulations for online sellers. Email is our contact channel, and our registration is publicly verifiable on the SSM register.
